Family dispute on entering father's estate into probate? - probate real estate sales
My father died in February 2008. My parents got divorced and never remarried. The will left all assets will be prompted to go to the estate and the estate only goes to the heirs.
The yard is very low, with a value of less than $ 30K. It is not good, only affects the staff, a van and a trailer. We (the heirs), easy to liquidate the property and spread evenly. We have created a small farm with affadavits heirs and have a federal tax ID, etc., all for legitimate goods.
Our grandmother (his mother) was interference from the beginning. After giving the keys and title in the truck and trailer and refusing us, when you enter the estate in probate, effectively blocking the sale of truck and trailer. This stagnation in it lasts for over a year, even after a lawyer had told him only to the heirs, but she was a field approval in force. We were not satisfied to bring the matter to her because they family, but eventually he will provide the restour property.
Somehow he managed to seek a hearing before the court and not just to get it against the will and the wishes of the heirs, but also for our uncle as executors.
How is this possible? We believe it could be included in the registration form? What should we do?
